7.5.3.8 EXEMPTIONS FROM IMMUNIZATION REQUIREMENT:
   A.    Exemption by membership in recognized religious denomination: Any parent or guardian belonging to a recognized religious denomination whose religious teaching requires reliance upon prayer or spiritual means alone for healing and who seek exemption from the compulsory student immunization requirements of Section 24-5-2 NMSA 1978 for their child shall present affidavits from an officer of the denomination stating that the parents or guardians are bona fide members of the recognized denomination and the religious teaching of the domination requires upon prayer or spiritual means alone for healing. 7.1.1 [sic] Upon filing such affidavit, the child is exempt from legal requirement for a period not to exceed nine (9) months on the basis of any one certificate.
   B.    Exemption by certification of religious objection: A parent or guardian who cannot obtain an affidavit from an officer of a recognized denomination as described in Section 7-1 [sic], but whose religious beliefs, held either individually or jointly with others, do not permit the administration of vaccine or other immunizing agents, may apply for an exemption from immunization by submitting a certificate of conscientious objection to immunization.
   C.    The certificate must be signed in the presence of a notary public.
   D.    Upon presentation of a notarized certificate to the principal of the school to which a child seeks enrollment, the principal shall allow the either approved or disapproved by the director of the public health division.
   E.    The director of the public health division or a qualified designee may disapprove a certificate for failure to fully complete it or for failure to allege beliefs and practices sufficient to warrant an exemption from immunizations for religious reasons consistent with the legislative intention of Section 24-5-3, as explained in opinion of the attorney general no.75-69, dated December 8, 1975.
   F.    Every principal receiving a certificate of conscientious objection to immunization shall deliver the certificate to the superintendent of schools for the district by which the principal is employed within seven (7) days of the time the certificate has been received. The superintendent shall note on his or her records that a religious exemption has been claimed on behalf of each child so claiming and shall forward the original certificate to the director of public dealth division within seven (7) days of the time it has been received from the school principal.
   G.    Within sixty (60) days of receipt of a certificate of conscientious objection to immunization, the director of the public health division, or the designee shall review the certificate to determine whether the certificate has been duly completed and notarized. The public health division shall investigate as may be appropriate to ascertain that the exemption is a bona fide claim of religious beliefs and practices. The public health director or the designee shall advise in writing the parents or guardian of the subject child, and the superintendent of the school district which the child is attending, and the principal of the school at which the child has been conditionally enrolled that the claimed religious exemption has been approved or disapproved. In the case of disapproval of a claim to religious exemption, the director of the public health division or designee shall state the reasons in the letter of notification.
   H.    Every parent or guardian of a child whose claim on behalf of that child for religious exemption from the student immunization requirements is disapproved by the director of the public division shall have the right to pursue an administrative appeal from such disapproval. The manner and method of administrative appeal shall be determined by the secretary of the New Mexico department of health. [01/14/76, 10/31/96; Recompiled 10/31/01]

24-5-3. Exemption from immunization.

A. Any minor child through his parent or guardian may file with the health authority charged with the duty of enforcing the immunization laws:

(1) a certificate of a duly licensed physician stating that the physical condition of the child is such that immunization would seriously endanger the life or health of the child; or

(2) affidavits or written affirmation from an officer of a recognized religious denomination that such child's parents or guardians are bona fide members of a denomination whose religious teaching requires reliance upon prayer or spiritual means alone for healing; or

(3) affidavits or written affirmation from his parent or legal guardian that his religious beliefs, held either individually or jointly with others, do not permit the administration of vaccine or other immunizing agent.

B. Upon filing and approval of such certificate, affidavits or affirmation, the child is exempt from the legal requirement of immunization for a period not to exceed nine months on the basis of any one certificate, affidavits or affirmation.

Nothing in the Immunization Act [24-5-1 NMSA 1978] shall preclude the right of the patient, or the patient's parent or guardian if the patient is a minor, to claim exemption from immunization as defined in Section 24-5-3 NMSA 1978; nor shall anything in the Immunization Act require such patient to be included in the immunization registry if the patient, or the patient's parent or guardian if the patient is a minor, objects on any grounds, including that such registry conflicts with the religious belief of the patient, or the patient's parent or guardian if the patient is a minor.

• Sign the birthplan in front of a Notary.


• Submit the birth plan to your hospital or midwife. Keep a couple extra copies in case plans change.


• Make sure affected parties (doctors, nurses, etc) understand your requirements and wishes.


• Plan on having one or two trusted persons stay with the mother and child to watch the child at all times while in the hospital, so no unwanted injections are given the baby.

"The injectable form of vitamin K can rarely cause severe (sometimes fatal) allergic reactions when given by injection into a muscle or vein. Dear VacLib Members and Friends -

Wanted to give you all a heads up on state issued exemption forms. I haven't had to deal with this personally for several years, and I always crossed out sentences or clauses, and often adding some of my own, before signing their exemption of medical release type of forms. When Donna Carrillo began to diligently search out existing exemption forms and posting them, I read over a couple of them and encouraged people to make up their own whenever possible. After having a "closer encounter" with such a form - a form provided to the state of Idaho by the American Academy of Pediatrics and the Centers for Disease Control and Prevention and used by licensed Idaho daycares, I was shocked into the VERY REAL danger of signing these forms without changing them significantly.

Any form one affixes their initials to, dates and affixes their signature to at the end is a LEGAL document. All statements prior to your signature you must agree to fully OR restrict your signature to say that you are signing under TDC - threat, duress, and coercion. The form that my daughter was told she needed to fill out for this daycare is posted here: ChildCareExemptForm.pdf ChildCareExemptForm.pdf. On this form, she crossed out all the "nots" and in her personal statement she further clarified that she understands fully the risks of vaccinating her child.

I have since found out that most public schools and daycares in other states also use a similar form. Basically, by initialing and signing this form as is, you are admitting to understanding that "vaccine preventable" diseases are extremely deadly and ALSO admitting to negligence for willfully denying your son/daughter the life saving protection that vaccines offer. These forms are MEANT to not only be intimidating but to catch the legally ignorant off guard. This is very serious to me since all states have adopted the federally funded Child Abuse Prevention and Treatment Act which gives states the right to literally steal your children for up to 48 hours -- the time they have to prove child neglect OR abuse.

If it were ME, I would insist that they accept a form that I provide them since it satisfies the law. If there are any problems or they insist on me using their form, I would cite the law and ask the school or daycare provider where it actually says in state statute that this particular form is the only form that will satisfy the law. Since your parental rights are at stake here, it is best to be vigilant and err on the side of being overly cautious.

She is referring to the Refusal To Vaccinate From developed by The American Academy of Pediatrics, not a regular religious or conscientious exemption letter or form.
